Challenge to classify investigation to NIA

Mumbai: The accused in the case have challenged in the High Court the decision to transfer the investigation into the urban Naxalism case to the National Investigation Agency (NIA). However, the state government on Tuesday told the high court that it would not file any reply to the petition.

Accused Surendra Gadling has challenged the decision to transfer the case to the NIA. Justice S.S. Shinde and Justice. N.J. Gadling’s plea was heard on Tuesday before a Jemadar bench. The NIA is currently investigating the matter and will file a reply to the petition. No reply will be filed by the state government, public prosecutor Aruna Pai told the court. The court has fixed September 27 for the final hearing.

Gadling and Sudhir Dhawale have questioned the central government’s decision to classify the case to the NIA. The petition alleges that two years after the case was filed, there was no concrete basis to classify the case to the NIA.

There is no provision for the Central Government to allow it to classify once the investigation is completed. However, after the Shiv Sena, NCP and Congress-led government came to power, the Center suddenly shifted the probe from Pune Police to NIA in January 2020 to harass them, the petition said.
