Land scam case: Great relief to Pankaj and Sameer Bhujbal

A Mumbai special session judge on Wednesday acquitted Cabinet Minister Chhagan Bhujbal’s son Pankaj Bhujbal, nephew Sameer Bhujbal and two other directors of Devisha Infrastructure Pvt Ltd, Rajesh Dharap and Satyan Kesarkar. The four were booked by the Navi Mumbai Police under the Fraud and Maharashtra Ownership Flats Act (MOFA). A case was registered against Bhujbal brothers and others in 2015 on the complaint of a person from Chembur. The Bhujbal brothers were accused by the Mumbai Sessions Court of cheating in housing projects.

In the complaint, the two companies, including the Bhujbal brothers, had planned to sell 2,344 flats in 2015 and had collected Rs 44 crore. However, it is said that the project was not developed. Additional Sessions Judge H.S. Satbhai has acquitted all the four persons under Section 239 of the Criminal Procedure Code.

Yunus Sheikh had lodged the complaint on June 13, 2015. Summons were then served and then Sameer Bhujbal and Kesarkar appeared. He was immediately granted bail.

The directors of Devisha Infrastructure Pvt Ltd (DIPL) had filed an application for acquittal. The four had said they would develop Project Hexworld on a 25-acre site in Kharghar. He was fully aware that there was no building permit and no possession of the land. He misrepresented all these things with the intention of deceiving the flat buyers and sold 2,344 flats and collected Rs 44.04 crore from the buyers. He had deposited the proceeds from the sale in an account. It was used for personal use, not for that project. Buyers were not reimbursed or given a flat. A chargesheet was filed in the case on February 25, 2016.
